Panel OZE Introductory Offer Terms

These Terms apply from 22 September 2026 until withdrawn.

These Introductory Offer Terms (“Introductory Offer Terms”) set out the rules for the introductory offer for new Panel OZE Subscriptions (“Introductory Offer”) applied by the Operator on TransakcjeOZE.pl under Section 13(7) of the Website Terms.

§ 1. Organiser

1. The Website Operator and the entity applying the Introductory Offer is Fundacja “Europejska Fundacja Energetycznej Transformacji” (EFET), with its registered office in Warsaw, ul. Łucka 18 lok. 4/L, 00-845 Warszawa, KRS: 0001164353, NIP: 5273158205, email: biuro@fundacjaefet.pl (“Operator”).

§ 2. Duration

1. The Introductory Offer applies from 22 September 2026 until withdrawn. The Operator may end or change the Introductory Offer for the future by changing the Price List and publishing an updated version of these Introductory Offer Terms on the Website.
2. Ending or changing the Introductory Offer does not affect Subscriptions entered into before the date of its ending or change. A User who enters into a Subscription agreement while the Introductory Offer is in force retains the reduced fee for all three initial billing periods.
3. The Introductory Offer is not limited to a specified number of Users.

§ 3. Definitions

1. Price List: the Website price list within the meaning of the Website Terms, available at https://transakcjeoze.pl/cennik.html;
2. Regular Price: the fee for one billing period of the relevant Subscription plan, as set out in the Price List, charged outside the Introductory Offer;
3. Introductory Price: the reduced fee for each of the first three Subscription billing periods, applied under Sections 4 and 5;
4. Panel OZE Subscription: the service within the meaning of Section 13 of the Website Terms, available in the “Panel OZE (narzędzia)” (tools) and “Panel OZE plus odsłony Ofert” (Panel OZE plus Listing Unlocks) plans;
5. Billing period: the period within the meaning of Section 13(1) of the Website Terms: the first billing period is 30 days from activation of access, and each subsequent period is one month.

Capitalised terms not defined in these Introductory Offer Terms have the meanings assigned to them in the TransakcjeOZE.pl Website Terms (“Website Terms”).

§ 4. Scope and amount of the Introductory Offer

1. The Introductory Offer covers the “Panel OZE (narzędzia)” Subscription plan: access to the full versions of the Website's analytical tools (in particular Check capacity, RES curtailment risk, Licence and MIOZE registers, and Connection passport), with no limit on the number of objects. This plan does not include unlocking detailed Listing data.
2. The Introductory Price applies for the first three Subscription billing periods, calculated from the date the Subscription agreement is entered into. From the fourth billing period, the Regular Price stated in the order summary is charged, in accordance with Section 13(3) of the Website Terms.

3. The “Panel OZE plus odsłony Ofert” plan is not covered by the Introductory Offer. Its fee is PLN 490.00 excluding VAT (PLN 602.70 including VAT) per billing period, as set out in the Price List.
4. The fee schedule (the Introductory Price for the first three periods and the Regular Price for subsequent periods) is displayed in the order summary before the Subscription agreement is entered into. Amounts charged for subsequent periods do not change during the Subscription, subject to Section 13(4) of the Website Terms.

§ 5. Eligibility and conditions

1. The Introductory Offer is available to a User who enters into a Panel OZE Subscription agreement for the first time while the offer is in force.
2. A User is entitled to the Introductory Offer once only. It is not available to a User who previously held a Panel OZE Subscription in any plan, including a cancelled Subscription, or who used an introductory offer under an earlier promotion run by the Operator.
3. Automatic renewal may be cancelled at any time under Section 13(5) of the Website Terms. Cancellation during the Introductory Offer takes effect at the end of the paid billing period and does not entitle the User to a refund for a period that has started, subject to the withdrawal rights of a Consumer and an Entrepreneur with consumer rights (Section 25 of the Website Terms).
4. The Introductory Offer cannot be combined with discount codes or other reductions in the Subscription fee. It may be combined with promotions for other Website services (such as publishing or unlocking a Listing), unless the terms of that promotion provide otherwise.
5. The benefit of the Introductory Offer cannot be exchanged for cash or any other benefit, or transferred to another User or a third party.
6. The Operator may refuse or withdraw the Introductory Offer if there are reasonable grounds to suspect circumvention of the once-only rule, including by creating further Accounts or providing false information.

§ 6. Price information

1. The Regular Price stated in Section 4 is the price at which the “Panel OZE (narzędzia)” plan was offered outside an introductory offer during the 30 days before these Introductory Offer Terms took effect.
2. All amounts in these Introductory Offer Terms are stated in Polish zloty, excluding and including VAT at 23%.

§ 7. Nature of the Introductory Offer

1. The Introductory Offer is not a competition, game of chance, prize lottery, betting arrangement, promotional lottery, game whose outcome depends on chance, or any other form of game of chance provided for in the Gambling Act of 19 November 2009.
2. Information about the Introductory Offer published on the Website constitutes an invitation to enter into an agreement on the terms described, rather than an offer or public promise within the meaning of the Civil Code.

§ 8. Personal data

The Website Privacy Policy sets out the rules for processing Users' personal data in connection with the Introductory Offer.

§ 9. Complaints

1. A User may submit a complaint about the Introductory Offer under the rules and procedure set out in the Website Terms (complaints procedure), by emailing biuro@fundacjaefet.pl and providing the User's details, a description of the concerns and the requested remedy.
2. The Operator considers the complaint within 14 days of receipt.

§ 10. Changes to the Introductory Offer Terms

1. The Operator may change these Introductory Offer Terms or end the Introductory Offer at any time, provided that a change may not worsen the terms of Subscriptions entered into before it takes effect or affect rights already acquired by a User.
2. The Operator announces changes to the Introductory Offer Terms or the end of the Introductory Offer by publishing updated content on the Website.

§ 11. Final provisions

1. The Introductory Offer applies within the territory of the Republic of Poland.
2. Matters not governed by these Introductory Offer Terms are governed by the Website Terms.
3. These Introductory Offer Terms are governed by Polish law.
4. These Introductory Offer Terms apply from 22 September 2026 until withdrawn, subject to Section 10.

Archived versions

The Operator retains archived promotion terms together with their periods of validity and makes them available at a User's request.
