Connection agreement expiry clock

From 30.04.2026 a connection agreement for a grid above 1 kV expires by operation of law where the connecting party fails to notify the operator in time that it has obtained a final building permit decision (Article 7(2a) of the Energy Law, added by the Act of 13.03.2026, Journal of Laws 2026 item 516). The deadline depends on the date the agreement was concluded and on the type of installation.

Agreements concluded on or after 30.04.2026: 24 months from conclusion: photovoltaics with inverters and BESS storage (a permit for at least 80% of the capacity covered by the agreement) and consuming equipment (at least 50% of the capacity). 36 months: wind turbines, biogas and agricultural biogas installations, transformers and switchgear. 60 months: installations and facilities supplying railway traction networks.
Agreements concluded between 30.04.2022 and 29.04.2026: Deadlines counted from 30.04.2026: 30 months (photovoltaics, BESS, consuming equipment), 42 months (wind, biogas, transformers and switchgear), 60 months (railway supply). Basis: Article 13 of the amending act, applicable from 16.10.2026.
Agreements concluded before 30.04.2022: From 30.04.2026: 6 months for wind turbines, 3 months for the remaining installations (Article 14 of the amending act, applicable from 16.10.2026). The rule does not cover agreements under which part of the installation has already been connected, nor railway supply.
Extension of the deadline: On an application filed before the deadline expires, the operator extends it by no more than 24 months, once only, after an additional security of PLN 60 for each kilowatt of connection capacity, up to PLN 12,000,000, has been lodged (paragraphs 2h and 2i). Circumstances beyond the party’s control (natural disaster, acts of war, embargo, a Ministry of National Defence protection zone, supply chain disruption, protracted proceedings) protect against expiry once a statement with supporting documents has been filed (paragraphs 2b and 2c).
Exclusions: Nuclear investments and offshore wind farms carried out under special acts (paragraph 2j).

This is a statutory deadline. The connection agreement itself may contain its own provisions on deadlines and on the consequences of missing them, so check the date of conclusion and the wording of the agreement in the document, and for an agreement predating 30.04.2026 also whether part of the installation has already been connected.
